Conflict Management in the Workplace Certificate Program - Graduate - 2012 University Catalog

The certificate program provides students with theories and skill sets to create and maintain conflict management systems that balance organizational, legal, and human resource factors, with the goal of increasing productivity while limiting legal liability.  It is designed for directors, managers, supervisors, and those wishing to be promoted to those positions in regulatory areas most closely identified with human resources, human resource management, and human capital

Admission Requirements

Candidates for admission to the proposed certificate program may meet less stringent requirements than the minimum requirements for the Legal Studies programs of Montclair State University currently required by The Graduate School such as maintaining a grade point average of 3.0 or greater in their undergraduate work. No GRE is required for entry into the certificate program.

The certificate will allow the waiver of GRE requirement for successful certification graduates with GPA over 3.0 who wish to enroll in the M.A. in Legal Studies.

Time for Program Completion:

Program completion will normally be with a one and one half year cycle.

ADMISSION

All candidates must meet the basic admissions requirements for graduate study at Montclair State.  The completion of a major from an accredited college or university is preferred.  Candidates with degrees in closely related areas will be considered, although prematriculation coursework may be required.

DEADLINES

Credentials are processed as soon as they are received.  This program does not have a specific deadline; however, The Graduate School recommends that students submit their credentials as far in advance as possible for the semester they plan to begin their studies to ensure a timely review of their application.

Course Descriptions:

LAWS551: Negotiation Theory and Practice (1 hour lecture, 3 hours lab)

In-depth study of negotiation theories and practical applications. Includes an examination and comparison of various negotiation theories and critical skills needed to be an effective negotiator. Extensive role plays. Study of ethical and policy issues. 3 sh.

LAWS553: Arbitration and Other Alternative Adjudicative Processes (3 hours lecture)

In-depth examination of the theory and applications of arbitration and other adjudicative processes. Utilization of role plays to expand student knowledge and ability to understand increasingly complex issues. Examination of policy and ethical issues and exploration of case law research. 3 sh.

LAWS556: Dispute Resolution in the Workplace (3 hours lecture)

Critical study of procedural and substantive legal principles of dispute resolution in the workplace. Exploration of procedures such as negotiation, mediation, arbitration, fact finding, and grievance resolution through collective bargaining which is the core of dispute resolution in both private and public sector employment. LAWS 551 is recommended as a prerequisite. 3 sh.

LAWS578: Legal Aspects of Human Resource Management (3 hours lecture)

In-depth study of procedural and substantive legal principles of human resource management. Exploration of the various procedures which can and should shape the work environment in both private and public employment. 3 sh.
