FMLA/NJFLA Parental Leave

The Family and Medical Leave Act (FMLA) and the New Jersey Family Leave Act provides protection from any negative impacts to your job when you take time off or a leave of absence for any of the following reasons:

  • Prenatal medical care or incapacity due to pregnancy and/or delivery;
  • To bond with a child within 1 year of the child’s birth or placement for adoption or foster care;
  • To care for a family member or equivalent who has a serious health condition ;

Eligibility

You may be eligible for Parental Leave if you:

  • have worked for the University for at least 12 months as of the first day of leave ; and
  • have worked for at least 1,000 hours in the 12 months prior to the first day of leave

The Pregnant Workers Fairness Act (PWFA) guarantees the affirmative right to receive reasonable accommodations for known limitations related to pregnancy, childbirth, or related medical conditions. These accommodations must not pose an “undue hardship” on the employer. Short term accommodations under PWFA may run concurrently with FMLA leave. PWFA (Healthcare Poster)
